A bid to invalidate his contract failed

AN application to invalidate the Ekurhuleni city manager’s employment contract failed at the South Gauteng High Court on Thursday.

The court declined to declare the extension of Khaya Ngema’s contract unlawful and invalid. It also declined to review and set aside the Ekurhuleni Metropolitan Council’s resolution extending the contract of the city manager.

The matter is being referred to the Gauteng MEC for Housing and Local Government for consideration within 10 days from date of judgment.

The effect of the court order is that the resolution of council of September 27, 2012, and the extension of the city manager’s contract is, for all intents and purposes, lawful, and that the city manager continues to perform his duties as the accounting officer of the municipality.
