NOTICE OF SUBSTITUTED SERVICE OF THE NOTICE OF MOTION FOR MONETARY JUDGMENT AND AN ORDER DECLARING THE IMMOVABLE PROPERTY SPECIALLY EXECUTABLE
TAKE NOTICE that pursuant to an Order of the High Court of South Africa, Gauteng Division, Johannesburg, granted on 17 August 2026, the Applicant is authorised to effect substituted service upon the First and Second Respondents of the Applicant`s application under case number 2026-124470 for:
1. Monetary judgment against the Respondents; and
2. An order declaring the immovable property described as Erf 88 New State Areas Township, Registration Division I.R., Province of Gauteng, held under Deed of Transfer No. T9919/2022, situated at 11 Boyes Street, New State Areas, Springs, Ekurhuleni, Gauteng, specially executable in terms of Rule 46A(1)(a)(ii) of the Uniform Rules of Court (“the Rule 46 application”).
TAKE FURTHER NOTICE that the Rule 46 application will, if unopposed, be heard on the 9th day of November 2026 at the High Court of South Africa, Gauteng Division, Johannesburg, or on such date as may be allocated by the Registrar.
The Respondents, and any other party entitled to do so, are hereby notified that they shall have 10 (ten) court days from the date of the last act of substituted service effected in terms of the Order within which to deliver a notice of intention to oppose the Rule 46 application, and 15 (fifteen) court days thereafter within which to deliver any answering affidavit. A copy of the Rule 46 application and supporting papers may be obtained from the Applicant`s attorneys at:
