The charges are based on the Auditor General’s report for the 2015/16 financial year which apparently found fruitless and irregular expenditure incurred by Govan Mbeki Municipality of about R256-m.
The party alleged the irregular expenditure occurred when laws and regulations in terms of the Municipal Finance Management Act and the Public Finance Management Act and supply chain management guidelines were flaunted when goods and services were procured in the 2015/16 financial year.
The EFF said Section 38(1) of the Public Finance Act empowers any member of the public or council to open a criminal case against transgressors.
Mr Anthony Mukhwanazi, EFF whip, said the former mayor and former municipal manager did not launch an investigation into the expenditure, hence they should both be charged in terms of the Public Finance Management Act.
“The municipality is losing hundreds of millions of rand on irregular, wasteful, fruitless and unauthorised expenditure annually, yet nobody takes accountability.
“This money is enough for instance to tar or pave all the roads in eMbalenhle, Lebohaang and eMzinoni.
“It is time that the accounting officer and the political leadership account for these losses.
