Murder accused granted bail because of shoddy work by the state

JOBURG – Failure by the DPP to give direction on case sees murder accused granted bail, with strict conditions.

 

Sandile Nkosi was granted R8 000 bail by the Alexandra Magistrates’ Court on 11 May. Nkosi is accused of a murder that he allegedly committed in July last year and had been in custody since his arrest last year. Prior thereto, Nkosi had been on the run for about three months.

He was arrested following an intense search by the police and was found hiding somewhere in Pretoria. It is alleged that the accused shot and killed his ex-girlfriend’s boyfriend in Alexandra last year. The accused, the deceased and the ex-girlfriend are understood to be Alexandra residents but the accused’s bail condition doesn’t allow him to stay in Alex anymore.

Magistrate Renier Boshoff told the accused that he only had to be in Alex for his court appearances. For the duration of the court case, the accused will be staying with his relative on the East Rand.

Nkosi was previously denied bail but the court had to reconsider because the state’s house was not in order. The matter was remanded several times for the Director of Public Prosecutions to give direction on where the matter will be heard, whether in a Regional Court in Alexandra or at the High Court in Johannesburg. It is understood that investigations have been completed and the only outstanding thing is the decision by the DPP on where the case should be heard. In granting the bail, Boshoff told the accused to not make contact with any of the state witnesses, including the ex-girlfriend, whether directly or indirectly. Boshoff also told that the accused that the state had a very strong case against him. The case has been remanded 18 May for the DPP’s decision.
