COURT ORDER
Having read the documents filed of record, and having heard Counsel for the Applicants and having considered the matter,
IT IS ORDERED THAT:
1.The Applicants are granted leave in terms of Section 21(1) of the Matrimonial Property Act 88 of 1984 to change their matrimonial property system.
2.The matrimonial property system existing between the Applicants is ordered to no longer apply to their marriage from the date of registration of the Notarial Contract referred to in paragraph 3 below;
3.The Applicants are authorised to execute and register a Postnuptial Notarial Contract, a draft copy which is annexed to the Supplementary Affidavit and is attached to this order as annexure `A`, to regulate their future matrimonial regime to out of community of property with the exclusion of the Accrual System;
4.The Registrar of Deeds is authorised and directed to register the postnuptial contract executed by the Applicants provided that:
4.1 The contract is submitted to the Deeds Office for registration within three (3) months from the date of this order;
4.2 All standard legal and regulatory requirements of the Deeds Office are fully met.
5. This order shall be published in the Government Gazette and a local paper within thirty (30) days of this order being granted.
6.This order and the registration of the postnuptial contract shall not prejudice the rights of any creditors whose claim arose prior to the registration date of the contract.
