The lack of knowledge of the much-debated Spluma law is the reason why RealNet hosted a Spluma information evening.
During the information session on Thursday, February 27 several expert speakers took the stand to explain Spluma.
“This information evening is extremely important to property owners, sellers and buyers. This affects the valuation of your property. Is the zoning correct, are the building lines following the municipal laws, are your building plans approved,” Ms Marlé Coetzee from RealNet explained.
First up was Ms Ansonet Steyn who heads the conveyancing division at Krugel Heinsen Inc particularly involved in developments and sectional title schemes.
Her first question was one that so many residents asked these past few months, why is Spluma here?

In essence, the legislation introduced the Spluma certificate which the National Deeds Office will now require from the local municipality in which a property is located before any property transaction can be concluded.
“The local municipality has to now implement their Spluma by-laws,” Steyn said.
Emalahleni Local Municipality stepped up on their own by-laws in February 2016 when they adopted the Spluma law.
Ms Laurette Swarts from Korsman and Associates Town and Regional Planners said the municipality will only issue a Spluma certificate if approved building plans are in place, the homeowner has a clearance certificate and the zoning is in place.
Mr Leon Viviers from LV Concept and Design’s advice is that you get an architect on board if you plan to sell your house and you know that you do not comply with the requirements.
Mr Barry Wagner from Harvey, Nortje Wagner & Motimele Attorneys said to avoid hiccups when you want to sell your property, start to get everything as required by the Spluma-law in order to avoid frustration.
