Woman convicted of stabbing her lover’s wife has sentence overturned
It was a normal romantic rendezvous for Botha and her lover Nick de Koker at the Dros in Krugersdorp until his wife and child showed up.
Six years ago, Odette Botha stabbed her lover’s wife, Tracey de Koker, and killed her.
She was convicted of murder and sentenced to 12 years in prison. She appealed this decision and the Supreme Court of Appeal overturned her conviction last week.
Botha and Nick de Koker, her lover, were at the Dros in Krugersdorp North when De Koker’s wife unexpectedly showed up with their son.
It is reported that De Koker started screaming at the couple and attacked Botha. De Koker then went back to her car and her husband followed her.

De Koker and her husband had an argument and she smashed his car’s windshield with a stone. She then came back to Botha who was still sitting at the table, and started attacking Botha and screaming at her.
Botha admitted she stabbed De Koker with a knife that was lying in front of her on the table, but only realised what had happened when she saw De Koker bleeding.
Justice Zukisa Laurah Lumka set Botha’s previous conviction and sentence aside. It was replaced with a culpable homicide conviction and a three-year prison sentence. The judge said that there had been no evidence that Botha could foresee the possibility of death when she directed a stabbing movement towards the deceased’s upper body.
