Memorandum regarding unresolved matters

Placement
This item was also presented in the Local Labour Forum on March 3, 2016. The resolution was that the placement and appeals report be provided to the Local Labour Forum, placement be re-opened to address the outstanding issues and labour unions engage with Management to address issues of employees. The management has failed to implement the resolutions.
Organogram
The employer and council in 2015 approved an Organogram without proper consultation with Labour Unions. On May 18, 2016, amended Organogram was again approved in the council meeting without proper consultation with the union.
Policies
The employer was requested by Union to do a Workshop on policies before they are adopted, reviewed or implemented. This request was in vain.
Inspection report of the building / unsafe conditions of the building
The union wrote to the Municipal Manager on February 16, 2016, and presented an item to Local Labour Forum regarding the unsafe conditions of the building. Union requested the occupancy certificate and Engineers report. Local Labour Forum resolved that the safety issues raised by labour be attended to and snag list with time-frame and progress be provided. The employer has failed to comply.
Travel allowance calculation
Using their selective distortion, the employer decided to take part of Department of Transport Rates / Tariffs in calculating the rates of municipal employees. Union demands that the Council adopt and reimburse all employees on car with AA rates for Vehicle Operating Costs / rate per kilometres fixed by the Minister of Finance at R3.29 per kilometre.
Unfair discrimination: equal pay for equal work
Union wrote to the Municipal Manager on February 15, 2016, and presented the item on Local Labour Forum on March 3, 2016. Local labour Forum resolved that the Management and labour deliberate on the issue. It was also resolved that the advice from other Municipalities on the same grading and same functions pertaining benchmarking, parity and job evaluation be requested. Management has failed to meet with labour to engage further on this issue.
Union demands that employees performing same duties, ie Officers, be reimbursed on a same scale / notch and also taking into consideration the experience and qualifications where possible. Where salaries were not benchmarked with other Municipalities, Municipality benchmark salaries of those functions taking into consideration the experience and qualifications of affected employees, eg Environmental Health Practitioners.
Union also demands that all Personal Assistants (PA) be appointed on a permanent basis as it is the case with the Personal Assistant: Municipal Manager.
Grievances not attended by Municipal Manager
Union has written grievances to the Municipal Manager and General Managers. These grievances were neither attended nor acknowledged. Some are attended after expiry date.
Cancellation of policy stop orders
The employer has cancelled employee’s stop orders without informing them prior. All employees affected, their stop orders be reinstated with immediate effect.
Job descriptions
Employer has failed to provide some employees with Job Descriptions. All employees be provided with job descriptions that have been agreed upon and signed by all Unions.
Group Life
Employees demand their refunds from the employer.
Intimidation of IMATU members and shop stewards
IMATU members get bullied, intimidated and undermined by Management unlike SAMWU shop stewards who get to share a cup of tea with the Management. (amadlelandawonye)
Employment of temporary employees
The Council has employed temporary employees for more than a period of three months. In the month of June, the council advertised some of the vacancies of which IMATU union fully supports. However, some of the vacancies were not advertised, ie in the Finance Department employees who have worked in the Municipality for more than three months be employed permanently.
Recommendation
THE EMPLOYER MUST ATTEND TO ALL THE AFOREMENTIONED DEMANDS WITHIN 7 WORKIING DAYS OF RECEIVING THIS MEMORANDUM
