UPDATE – The case againstĀ Mduduzi Mfundisi Nzuza and Sam Baloyi, the police officers who allegedly shot rapper Khuli Chana in October last year, has been postponed yet again at Randburg Magistrates’ Court today, much to the dismay of Magistrate Vincent Pienaar.
Prosecutor Pieter Erasmus requested for the trial to be postponed for another week in order for further discussions to take place between defense attorneys and the State so they can review a proposal which has been drafted and signed by the defense and handed to senior SAPS officials.
These discussions needed to include testimony from an advocate ‘Brooderyk’ from the Department of Public Prosecutions, but the advocate was not available.
Magistrate Pienaar refused the request, however, stating that the trial has been postponed for far too long. “The case will resume at 9am tomorrow (10 September). The prosecution and defense must have all witnesses present.”
Defense attorney to the two accused, Thumelo Thomas, stated that he feels that great progress has been made by both parties [prosecution and defense] in the case.
