Pistorius: Bid for leave to appeal to be heard next month

The National Prosecuting Authority said its application for leave to appeal against the conviction and sentence of Oscar Pistorius will be heard on 9 December.

An application for leave to appeal against the conviction and sentence of paralympian Oscar Pistorius for the death of his girlfriend Reeva Steenkamp will be heard on 9 December, the National Prosecuting Authority (NPA) said on Monday.

It said the matter would be heard in the High Court in Pretoria.

NPA spokesperson Nathi Mncube said: “The NPA reiterates that the decision to appeal was taken on the basis that it believes there exists reasonable prospects of a successful appeal based on a question of law.”

He said it was critical for the NPA to seek clarity on the principle of dolus eventualis from the Supreme Court of Appeal, cited by Judge Thokozile Masipa in her verdict.

Dolus eventualis is where an accused could foresee the consequences of his or her actions.

Pistorius is serving a five year prison sentence in the hospital wing of the Kgosi Mampuru prison.

He was convicted of culpable homicide for killing Steenkamp on Valentine’s Day in 2013, and sentenced last month.

Earlier in the day, the department of correctional services denied allegations that Pistorius would be getting a special bathroom.

Spokesperson Manelisi Wolela reportedly said Pistorius was using a communal bathroom.

“The planning and actual work to construct a bathroom and general maintenance by contractor RC Civils started a long time ago. It is part of a three-year repair and maintenance program and was due for completion on 31 May 2014 – many months before Oscar was even found guilty,” Wolela was quoted as saying.
