Solidarity trade union filed criminal charges against former Eskom CEO Brian Molefe and his board chair Ben Ngubane today.
Molefe and Ngubane worked together to award an “unlawful” R30-million pension to Molefe, according to Solidarity chief executive Dirk Hermann.

Hermann said other Eskom executives such as Anton Minnaar – the manager – as well as members of Eskom’s remuneration committee and board members must also be probed “since they failed in their legal duty to disclose unlawful activities”.
“We are asking that both be charged in terms of the public finance management act, the companies act, the prevention and combatting of corrupt activities act, and the prevention of organised crime act,” said Hermann.
A conviction can mean 10 years’ imprisonment.
Solidarity further requested the Hawks investigate the case and that the allegations be tried in court.
Solidarity’s action comes in the wake of a recent finding by a full bench of the North Gauteng high court which invalidated Molefe’s R30 million pension payout.
Hermann said it was “clear that Molefe and Ngubane colluded to devise the unlawful payout”.

“Its final approval was given under Ngubane’s signature and done in terms of a provision that was not applicable.”
They both knew that Molefe did not qualify for the payout but nonetheless made deliberate misrepresentations,” said Hermann.
