MLM refutes alleged attack on transport business

Neethling said the harassment is causing emotional trauma and financial devastation.

MIDVAAL. – The Midvaal Local Municipality (MLM) refutes claims made by a local e-hailing Tuk Tuk taxi service business owner, that his business is being targeted.

In a Facebook post on March 4, Jaco Neethling said his business was under attack.

“We can no longer stay silent. The Midvaal Traffic Department has launched a targeted campaign of harassment against our tuk-tuk drivers, and it is destroying our business, our livelihoods, and our mental well-being.”

Neethling said that on that day, two of his brand-new, only-one-month-old tuk-tuks were issued a fine for being unroadworthy.

“This is beyond absurd! Our vehicles are fully compliant, yet officers are pulling over our drivers daily, fabricating violations, and issuing unlawful fines in what appears to be a deliberate attempt to shut us down.”

Neethling revealed that they had credible information that traffic officers had been given a direct order to make them feel the heat.

“This is a clear case of intimidation and abuse of power.”

Neethling said the harassment is causing emotional trauma and financial devastation.

“We are hardworking people trying to provide a service to our community. We will not stand by and watch our business be crushed by unfair enforcement tactics.”

On March 6, MLM released a statement on behalf of the acting Municipal Manager Phumudzo Magodi.

“MLM would like to clarify its position on public transportation regulations and emphasise the importance of compliance with all relevant laws.”

Magodi said the negative perceptions directed at MLM concerning tuk-tuk operations are unfounded and fail to recognise the serious risks posed to road users, passengers, and residents. Magodi highlighted that the operations were being carried out without permits.

“These operations, which are being conducted without the required permits (Operator Permits) are unlawful and threaten public safety. As a responsible municipality committed to good governance and upholding the rule of law, MLM takes a zero-tolerance stance on unlawful activities within the region.”

“The Midvaal Traffic Department is responsible for enforcing applicable laws and regulating the transportation industry within the Municipality. This includes all forms of transport.”

Furthermore, Mogodi said issuing permits falls within the jurisdiction of the Sedibeng District Municipality.

“The Midvaal Traffic Department can only enforce the law in cases of non-compliance. Users of these non-compliant services are advised against using them, as their insurance coverage may be compromised in the event of accidents or, tragically, fatalities. The Midvaal Traffic Department rejects any harassment claims made by certain parties.”

Speaking to Ster North, Neethling confirmed that he was aware of the statement released by MLM. He said he would furnish Ster North with a response in due course.
