R8k bail granted to each of the 5 repeat offenders in South Hills murder case

The Booysens Magistrate’s Court granted bail to all five accused, including a 17-year-old minor, despite concerns from the magistrate about their criminal history.

Five suspects in the South Hills murder case appeared in the Booysens Magistrate’s Court on October 10.

The 17-year-old minor involved is accused number five.

The case was before the court for formal bail applications for all five. Each had their own lawyer, which caused a lengthy delay, as a lawyer was not in court to complete the bail application for accused two.

Magistrate Mashitse stood the matter down so the lawyer could arrive in court. The other lawyers were unhappy about the delay, with Advocate Wits, who represents the accused one, complaining about the postponement.
After a long wait, the court decided to proceed with the bail applications.

As a minor was involved, the media was not allowed to be present in court when the minor appeared. After the minor’s application was complete, the media were allowed back into court.

Mashitse said he did not want to grant bail to the accused because they were all repeat offenders.

“I did not want to grant bail to the accused, as I see that each of them is a multiple-time offender. I feel you all pose a danger to your communities. However, I will grant R8 000 bail for all five accused on the condition that each reports to the Moffat View Police Station twice a week to check in. This is to monitor your whereabouts until you return to court,” said Mashitse.

The court remanded the case to November 5, and Mashitse warned all five accused to be in court that morning.
