The 23-year-old man accused of shooting Luke Tibbetts appeared in the Johannesburg High Court in Palm Ridge on March 2 and has 18 charges against him.
He is charged with the murder of three-year-old Luke Tibbetts and 17 other crimes including illegal possession of a fire arm and aiming a fire arm at another person.
According to the prosecutor Deon van Wyk, the accused had an altercation with his co-accused, Keenan Mokwena, after which Mokwena allegedly fetched his gun from home.
Tibbetts was sitting on his mother, Candice’s lap in the back seat of a car when he was struck by the stray bullet, allegedly from the accused’s gun, that put him in hospital. After six days in a comma the three-year-old died.
The state’s case is relying on the fact that he knew the consequences of his actions when he fired his gun in a residential area.
According to the indictment the accused is also charged with the attempted murders Andre Mooi and Ronald Plaatjies in Janury 2013. He then allegedly shot and injured Logan Smith five months later.
He is also alleged to have shot and killed Alton Mooi, shot and injured Shane Williams and shot twenty bullets at a car where another man was in.
He pleaded not-guilty to all charges.
Andre Mooi was the first to testify for the state on March 2.
The case continues on March 4.
