The man believed to be responsible for the assault of the owner of Cheekies, has been shipped back to Winterton for an upcoming court case.
“Winterton Police is currently investigating two cases against the suspect. A case of using motor vehicle without owners’ consent which happened on March 18, as well as a case of escaping from lawful custody which happened on March 19,” said Major Shooz Magudulela, KwaZulu-Natal communications.
Both matters are currently before Colenso Magistrate Court. The suspect’s bail was abandoned and he is currently in custody awaiting trial on May 12. The suspect was originally sentenced to 12 months imprisonment with a suspended sentence on conditions that he attends rehabilitation at Castle Craig Centre, Newcastle, KwaZulu-Natal, where he escaped police custody.

His sentence is expected to be put into operation following his alleged escape from custody as well as the new charges being brought against him.
The suspect, after appearing in Colenso Magistrate Court under the prosecution of Mr Khulekani Mncube, will be transported back to eMalahleni to face the charges of robbery and assault against him on May 18 in the B-Court of Witbank Magistrates Court under prosecution of Mr Alfred Grobler.
This stems from an incident that occurred on Sunday April 17, where Mr Johan van Zyl was brutally assaulted as he was locking up his bar, his alleged assailant was caught and the following evening somewhere in Extension 8, he was handed over to police
He appeared before Witbank Magistrates Court on April 20 facing charges of robbery and assault. His bail was abandoned in this case due to outstanding cases and the bail money in the previous case of shoplifting was forfeited to the state as he did not appear in court. His case was remanded for May 18 for plea and he was returned to police custody.
Winterton Police transported the suspect from Witbank Magistrates Court to Winterton Police Station where he remains in custody awaiting his court date at Colenso Magistrate Court.
Additionally the suspect is expected to serve consecutive sentences should he be found guilty before both courts.
