No sleep for residents as music blares

Since the popular night club Tin Cups closed its doors earlier this year, a new pub and grill called Die Heuwel Tshisa has opened and residents in the area are battling to get a good night’s rest on weekends as it sounds like the party is in their homes all the way up to Woltemade Street in Die Heuwel.
Residents living approximately one kilometre away can hear the music.
Die Heuwel Tshisa is situated in OR Tambo Street next to the Sasol Garage on the corner of Gordon Street.
The main problem is that they make a noise until 02:00 in the mornings.
A resident who lives in Woltemade Street said;
“they are usually quiet on Tuesday but on Sundays they are extra loud.”
The other problems is that they have big fires outside just next to the petrol station, some people stand outside the club and drink there, it gets so busy there that traffic is an concerning issue.
“I have phoned the police every night that they make a noise and they send out a vehicle to quiet them down. But once they are gone, they start over again,” he continued.
Since then a case has been opened at Witbank Police Station about the noise pollution that Die Heuwel Tshisa is creating.
Die Heuwel Tshisa is opened from Monday- Sunday. And on a Thursday they have Sheilasday, Hip Hop and RNB, Friday and Saturday is Deep House and Commerical and on a Sunday is a Soul Session.

According to the law there are two kinds of noise. A Disturbing Noise is objective which is a scientifically measurable noise level and generally compared to the existing ambient noise level. This can include machinery, amplified music, and even animals if they make noise above a certain decibel.
The Environment Conservation Act, 1989 (Act 73 of 1989) – Noise control regulations, 1999. This kind of noise is always illegal and can be reported 24 hours a day in residential areas.
The World Health Organisation has linked disturbing noise to various mental and physical health issues such as impaired hearing.
A Noise Nuisance is a subjective measure and is defined as any noise that “disturbs or impairs or may disturb or impair the convenience or peace of any person.” This kind of noise is usually handled in municipal by-laws but includes musical instruments and television sets among other things.
If you have similar complaints a criminal case can be opened under the Environment Conservation Act.
“The community should work with us, come to us with facts about the noise, what time so on as the noise could be coming from anybody,” said Mr Tshepho Mashele Manager of Die Heuwel Tshisa.
“If it is our music making a noise we will turn the music down so people in the area can have sleep,” continued Mashele.
