Still no plea from Van Zyl’s assailant

Mr Johan van Zyl’s assailant was brought up from Winterton, KZN for the second time in the same week, to appear for armed robbery with aggravated circumstances.

The 21-year-old man was accused of committing the crime on April 17 this year when he allegedly assaulted the pub owner of Cheekies’ as he was locking up shop. He then allegedly robbed the business.

The accused appeared before Witbank Magistrates Court on Monday, August 22. He was taken back into custody in Winterton and was again brought up to eMalahleni on Thursday August 25.

The accused sits alongside his girlfriend at Witbank Magistrates Court.

Correctional Services are in the process of arranging a transfer of the accused from Ladysmith to Paxton Correctional Services.

His case was postponed awaiting his attorney.

“I am having an issue with the attorney and want to apply for legal aid,” said the accused, who has yet to plea to the allegations.

His reasoning was that his grandparents are paying the legal fees and he would like to consult on the matter before pressing on.

Magistrate Marlene Greyvenstein remanded the case for consultation to September 21.

*The accused has a further two charges against him in the Colenso Magistrates Court, that of using a vehicle without its owner’s consent, and a charge of escaping police custody, thus his bail in this case was forfeited and he remains in custody.
