LEGAL NOTICE: Foskor Acid Division Richards Bay applies for Atmospheric Emission Licence variation

The proposed variation is to incorporate the existing gas-fired boiler as a Controlled Emitter in terms of Section 23 of NEMAQA.

Notice is hereby given that Foskor (Pty) Ltd – Acid Division, Richards Bay intends to apply for a variation of its Atmospheric Emission Licence (AEL) with the King Cetshwayo District Municipality for its operations situated at 21 John Ross Parkway, Richards Bay, KwaZulu-Natal, 3900, in terms of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004) (“NEMAQA”).

This application is submitted in accordance with Section 46 of NEMAQA, which provides for the variation of Atmospheric Emission Licences.

Details of the Proposed Variation

The proposed variation is to incorporate the existing gas-fired boiler as a Controlled Emitter in terms of Section 23 of NEMAQA.

The gas boiler has a design capacity of 37 tonnes of steam per hour which equates to a boiler design rating of approximately 27 MW net heat input. Accordingly, the boiler is classified as a Controlled Emitter in terms of Government Notice No. 831 of 2013 (GN 831 of 2013). The boiler has a net heat input of 27 MW (less than 50 MW) and is therefore considered a small boiler.

As a result, the boiler does not trigger a listed activity under Section 21 of NEMAQA and is not subject to the Minimum Emission Standards applicable to listed activities. The proposed variation is therefore intended to formally incorporate the existing gas boiler as a Controlled Emitter under the Atmospheric Emission Licence.

Members of the public and Interested and Affected Parties (I&APs) are invited to register and submit written comments on the proposed licence variation, with the Atmospheric Impact Report for the gas boiler available at the Richards Bay Public Library and on the Foskor website for a period of 30 days from the date of publication of this notice. Any interested or affected party may make representations in writing to the Foskor site representative within 30 days should they have any queries or comments.

To register as an Interested and Affected Party please submit your name, contact details and written comments or enquiries, to the Foskor site representative:
