Life imprisonment for 31- year-old convicted of murder
Dundee Regional Court convicted and sentenced Themba Mthethwa (31) to life imprisonment for the murder of Sfundo Ndaba (37).
The murder occurred in February 2023 in the Pomeroy area.
The court heard that on 11 February 2023, Mthethwa, Ndaba and the witness had attended a funeral in the area.
After the funeral, the witness was going home when he saw Mthethwa and Ndaba going to a nearby house where alcohol was sold.
That evening, the witness was at a local shop when he saw Ndaba approaching from the direction of the place that sold alcohol.
Shortly thereafter, he saw Mthethwa emerging from the same direction, following Ndaba. He said Mthethwa shot Ndaba in the back and fled the scene, reportedly without any altercation. Ndaba died a few days later, and Mthethwa was arrested.
Prior to his death and after the shooting, Ndaba made a statement to the police, outlining the incident and implicating Mthethwa.
In court, Prosecutor Jabulile Nomfundo Zondi handed in Ndaba’s statement, which the court accepted as evidence.
Zondi further led the evidence of the eyewitness, the arresting officer, and the police officer who had taken Ndaba’s statement.
Mthethwa was convicted and sentenced accordingly. He was declared unfit to possess a firearm.
