Enrique da Silva case postponed again as defence prepares representations

The matter will return to Palm Ridge Magistrate’s Court on November 20, allowing the defence to submit representations to the senior prosecutor.

The case involving the death of Alberton motorcyclist Enrique Robbertze da Silva has been postponed again, with the next court appearance scheduled for November 20 at the Palm Ridge Magistrate’s Court.

The latest postponement, on Thursday (October 29), followed an earlier delay on September 30, when the matter was postponed because the defence had allegedly not received copies of the docket and evidence from the state to prepare for the trial.

Defence representations

The defence lawyer stated that this earlier delay was necessary to obtain the outstanding documents.

When the matter returned to court on Thursday, it was postponed to November 20 to allow the defence to submit representations to the senior prosecutor.

The representations will allow the senior prosecutor to consider the defence’s submissions and decide whether the case should proceed to trial.

The latest postponement means the family will have to wait longer for clarity on whether the matter will proceed to trial.

Da Silva died following a collision involving his motorcycle and a Volkswagen Polo near Kota Joe Roadhouse on May 2, 2025.

His mother, Mandy da Silva, has previously raised concerns about delays in the investigation and the handling of the case.

The state prosecutor had earlier confirmed that the investigation was complete when the accused made his first court appearance on September 11.

The Alberton Record will continue following the matter as it returns to court on November 20.
