‘Know your rights, prevent potential crisis’
Legal Practitioners Fidelity Fund CEO Motlatsi Molefe emphasised the importance of understanding consumer rights in the legal system and acting swiftly in seeking help to prevent potential crises.
Consumers must recognise that when they enlist a lawyer’s services, they are not relinquishing their rights, said Legal Practitioners Fidelity Fund CEO Motlatsi Molefe.
Molefe shared these words in a recent outreach initiative aimed at empowering legal service users with the knowledge they need to protect themselves against potential misappropriations by legal practitioners.

Among these rights is the ability to inquire about the contents of your lawyer’s file. “Transparency is key, and you deserve to know what actions are being taken on your behalf,” Molefe said.
Molefe expressed concern that many individuals were unaware of their rights regarding legal representation and often waited too long to seek help when issues arose.
“It is imperative for consumers to understand not only their rights but also the proper channels to address their concerns.
“Before proceeding with any legal services, always ask your lawyer for their Fidelity Fund Certificate. This certificate, not only verifies their credentials but also ensures that they are authorised to manage client funds responsibly.”
Molefe cautioned against paying a lawyer directly to their business account. “Instead, always make payments to their trust account, which guarantees that your money will only be used for its intended purpose and will be transferred to the business account only after the services are rendered.”

He encouraged consumers to be vigilant in their interactions with legal practitioners. “If you ever feel uncertain or suspicious of how your case is being handled, report any concerns to the Legal Practice Council immediately.
“Opening a case is crucial, and if you suspect any form of financial misconduct, make sure to file your claim within three months.”
The recent outreach event was a collaboration between the Legal Practitioners Fidelity Fund, the Legal Services Ombud and the Legal Practice Indemnity Insurance Fund, all to inform individuals about their rights and available support systems.
Molefe said after residents had shared their experiences, it became clear that many were unaware of where to turn for help when faced with legal challenges.
“Our presence here today is vital. We need to encourage individuals to act immediately rather than delay until a problem escalates into a crisis. Timeliness is crucial; many valid claims can expire if not addressed promptly.”
To create a more informed and proactive community, Molefe’s message was clear – knowing your rights and seeking help without hesitation is the best defence against potential pitfalls in the legal system.
“Take charge of your legal matters, and remember that help is always available. Don’t hesitate to reach out for assistance when you need it the most.”
