CoE faces contempt of court proceedings

Bedfordview resident takes CoE to court over poor service delivery.

The CoE claims to have done some repair work to Boeing Road East after accusations of failing to adhere to a court order to make the necessary repairs.

The claim comes after a resident took them to court earlier this year over a lack of service delivery.

Bedfordview resident Carlo Messina took the CoE to court over the poor state of Boeing Road East.

Messina has lived in Bedfordview for 36 years. He said that over the years, he had watched the level of service delivery gradually decline.

As a citizen, he was motivated to do something rather than complain.

Following the application against the Ekurhuleni council, the court issued an order for the metro to make the necessary repairs to the road.

According to the applicant, the repairs have not been executed.

Based on the document seen by Bedfordview and Edenvale News, the CoE was ordered to fully and properly repair the damage to the road.

The document further reads, “Including but not limited to repairing the water leaks near the adjoining G-Fleet premises and conducting a complete resurface of the road once such leak has been properly repaired by no later than September 30, 2023.”

Messina said despite agreeing to a court order and being ordered by a court to repair the roads by September 30, the city failed to honour its obligations.

“We are instituting contempt of court proceedings, which will include a prayer to arrest the mayor of Ekurhuleni. The road continues to be in a state of disrepair,” he said.

CoE spokesperson Zweli Dlamini said the repairs were done and completed after the court order date.

“The city could not repair the road on the initial date set due to constant running water from the government garage. However, the city resolved the matter on October 11,” said Dlamini.
