How to handle a self-defence situation

The obligation is on you, if attacked, to avoid the use of force against your perpetrators.

Dave Civin, of Civin-Alexander Attorneys, in the Benoni CBD, was approached for comment on how to handle a self-defence situation.

This comes after a man shot dead an intruder in his Lakefield home this morning (September 15).

Civin, who could not comment on this morning’s incident as he does not know the details of the case, said people may act in self-defence in any violent criminal activity against them.

“Generally speaking, you are entitled to act in self-defence if your life is in immediate danger,” he said.

“The obligation is on you to avoid the use of force, if possible.”

He said there is no prescribed way to handle a self-defence situation, as each case is different.

Civin said if you are armed and have time, warning shots should be fired, although the number of shots is not specified.

“The force used must be comparable to the force used against you,” he said.
