It’s illegal to pitch a tent on public roads – EMPD

The law states that obscuring a public road without proper permission is an offence.

The erection of a structure, especially tents pitched for funerals, weddings and parties, on a public road or street used by the public and motorists is prohibited.

Subsection (8) of Section 115 states attaching any object to a structure, pavement, tree, parking meter, lamp pole, electric pole, telephone booth, post box, traffic sign, bench or any other street furniture in or on a public road or public place is prohibited.

A public road is utilised by the public, whether walking or driving, so their rights must not be infringed. Anyone found to have pitched a tent or used any object to obstructing the roadway or pavement without permission shall be dealt with accordingly.
