NOTICE REGARDING THE PROPOSED WASTE MANAGEMENT ACTIVITIES AND PUBLIC PARTICIPATION PROCESS IN SUPPORT OF A WASTE MANAGEMENT LICENCE AND ATMOSPHERIC EMISSIONS LICENSE APPLICATION FOR AQUAGEL`S RECYCLING, RECOVERY AND TREATMENT FACILITY, LOCATED IN VULCANIA, BRAKPAN, GAUTENG. REF NR: 002/26- 27/W0007 INVITATION TO COMMENT AND PARTICIPATE AS AN INTERESTED AND AFFECTED PARTY Aquagel Pty (Ltd) (Aquagel), currently operates an existing waste recycling and biochar production facility at 2 Atomic Street, Vulcania, Brakpan. The facility receives untreated recovered wood waste and mineral rock dust for processing into biochar and a regenerative agricultural soil-enhancement product marketed as RegenR8. Aquagel now plans to establish a full-scale Regen8 production facility that entails having all recycling, treatment and recovery activities taking place within the Brakpan facility. Notice is hereby given in terms of the List of Waste Management Activities Listed in GN 921 Published under National Environmental Management Waste Act (No. 59 of 2008) (NEMWA), that Aquagel is applying for a Waste Management Licence (WML) for the proposed waste management activities at their site in Vulcania, Brakpan. In terms of the National Environmental Management: Waste Act (No. 59 of 2008) (NEM: WA), waste management activities that are listed in regulations published under NEM: WA may not be undertaken without a Waste Management License (WML). The listed activities for which a WML is required are contained in Government Notice (GN) 921. Category A activities require a WML and a Basic Impact Assessment (BA) process must be conducted, and Category B activities require a WML and a full Scoping and Environmental Impact Assessment process must be conducted. Only one WML application and a Basic Assessment process (BA) will be undertaken for the proposed waste management activities. The proposed expansion of the waste management activity triggers the following activity under Category A of GN 921: GNR 921 – Listed activity Description of listed activity A (3) The recycling of general waste at a facility that has an operational area in excess of 500m2, excluding recycling that takes place as an integral part of an internal manufacturing process within the same premises. A (5) The recovery of waste including the refining, utilisation, or co-processing of waste in excess of 10 tons but less than 100 tons of general waste per day. A (6)The treatment of general waste using any form of treatment at a facility that has the capacity to process in excess of 10 tons but less than 100 tons. A (12)The construction of a facility for a waste management activity listed in Category A of this Schedule (not in isolation to associated waste management activity). Therefore, a Basic Assessment Process will be followed in order to obtain a WML for the operational (recovery and recycling and treatment) activities planned by Aquagel. The proposed expansion activities also trigger a listed activity in terms of the National Environmental Management: Air Quality Act (Act 39 of 2004) (NEMAQA) as the production of biochar will now increase from 20 tonnes per month to 100 tonnes. The application will be submitted to the City of Ekurhuleni as the competent authority The following activity is triggered in terms of the NEMAQA: GN 893- Listed activityDescription of listed activity Category 3: Subcategory 3.4: Char, Charcoal and Carbon Black Production, due to the proposed production of more than 20 tonnes per month of char / biochar.
