UPDATE: No bail in high-profile child abuse material and assault case

The case involves allegations of drug-facilitated sexual abuse and the distribution of child sexual abuse material across digital platforms.

The Boksburg Magistrate’s Court has denied bail to the two men accused of offences relating to child sexual abuse material and sexual assault, finding that their release would not be in the interests of justice.

The accused, who are known to one another and reside in Boksburg and Germiston, face multiple charges, including sexual assault and the possession, production and distribution of child sexual abuse material. The second accused faces an additional charge relating to the possession of an unlicensed firearm.

Judgment in the bail application was delivered on May 4, following the conclusion of legal argument on April 23.
Both accused remain in custody and are expected to appear in court again on May 14 as the investigation continues.

Opposed
In opposing bail, the State argued that the release of the accused would prejudice the ongoing investigations.

The court heard that the investigation remains incomplete, with outstanding evidence including victim and witness statements, digital forensic analysis, and cybercrime reports.

The State further submitted that there is a risk the accused may evade trial. This argument was based, in part, on their reaction upon being informed of the potential severity of sentences if convicted, as well as their personal circumstances, including access to travel documents.

The court also considered allegations that one of the accused attempted to interfere with a witness.

An affidavit before the court stated that a victim received a phone call on March 29 from the first accused while he was in custody, during which he allegedly requested that she provide false information to investigators. The complainant refused and terminated the call.

Such allegations were presented by the State as indicative of a potential to undermine the administration of justice if released on bail.

Nature of the allegations
According to the State’s submissions, the accused are alleged to have engaged in the possession and dissemination of explicit material involving minors, as well as the non-consensual sharing of intimate material.

It is further alleged that one of the accused subjected his spouse to drug-facilitated sexual assault over a period of time, recording and distributing the content without her consent.

The court was told that electronic devices seized during the arrests form a central part of the evidence and are currently undergoing forensic examination.
Personal circumstances
The defence placed the personal circumstances of the accused before the court, including their family responsibilities and financial positions.

One accused is reportedly facing significant financial strain.
However, the court found that these factors did not outweigh the interests of justice.

The defence argued that accused number one should be granted bail, citing his lack of prior convictions or pending cases and contending that he poses no risk of interfering with the investigation.

Counsel submitted that a protection order prohibiting contact with the complainant adequately addresses concerns of intimidation. The alleged phone call made from custody was described as an isolated incident, with the accused complying when asked to cease contact.

The defence further argued that there is no confession statement before the court and that claims of admission are unsubstantiated.
It was also noted that the accused co-operated with investigators by voluntarily handing over his cellphone.

In support of bail, the court heard that the accused is employed, has family responsibilities, and suffers from a medical condition requiring ongoing treatment. The defence submitted that he could afford bail of R5000 and would comply with any conditions imposed.

Background
The accused were arrested on March 27 during a co-ordinated operation by the SAPS in Boksburg and Germiston.

The arrests followed an intelligence-driven investigation initiated after a tip-off from the United Kingdom’s National Crime Agency, with assistance from SAPS’ specialised units and United States Homeland Security Investigations.
