UPDATE: Bail verdict to be heard September 15 in Mbense case
The six accused remain in custody until September 15 when magistrate Colin Mashego will deliver his judgement on their bail applications.
Former EMPD chief Julius Mkhwanazi and his five co-accused appeared before the Brakpan Magistrate’s Court on Tuesday, September 8, to conclude final arguments in their bail applications.
Mkhwanazi , Cobus Janse van Rensburg, Adrian MacKenzie, Keisha-Leigh Stols, Bhekokwakhe Sibande and Juan-Marie Eksteen, all from EMPD, SAPS or private security, face charges of murder, robbery with aggravating circumstances and defeating or obstructing the administration of justice.
After the defence questioned the State’s evidence and the strength of its case, State prosecutor Nceba Ntelwa stood firm in his arguments.
Ntelwa argued that Mkhwanazi knew what was expected of him by ordering him to dump the body in the dam, and that he did so in front of everyone at the scene.
According to him, a significant piece of evidence against the group is the motive to recover 10% of the value of the stolen copper, worth R5m.
The next appearance will be September 15, when magistrate Colin Mashego will deliver his judgment on the bail applications.
