City Power vs Hawks: Court postpones urgent interdict hearing

City Power filed for a court interdict to suspend a search warrant after a Hawks visit to its headquarters, contending the warrant was executed unlawfully despite ongoing cooperation.

A team from the Directorate for Priority Crime Investigation (Hawks) visited City Power (CP) headquarters on September 17.

The visit was part of an ongoing 2024 investigation into the procurement of electrical equipment, such as transformers.
The Hawks had previously served CP with a formal request for information.

CP stressed that the visit was part of a normal investigation, not a raid.

The entity stated that it continued to co-operate with the lawful process and remained committed to providing all necessary information.

However, it contended that the search warrant related to the RFI was unlawfully executed and filed for a court interdict, which is postponed to October 10.

The Johannesburg High Court made the decision in connection with the execution of the search warrant carried out on September 17.

According to CP, the Hawks were furnished with relevant documents and had time to prepare, but only submitted their opposing affidavit on the evening of the hearing.

CP is seeking an urgent interdict to suspend the warrant’s execution until full arguments are heard.

“The case will again be heard on October 10,” said the CP general manager of the department of communication and public relations, Isaac Mangena.

The entity emphasised that it would co-operate with lawful investigations but cited procedural irregularities in the Hawks’ probe, which began in November 2024.

CP hopes the Hawks file papers by 18:00 on October 9 for a response, as requested by Judge Yacoob.
