Court hands community service and house arrest to Heidelberg driver

Alec Smith (20) has been sentenced for the reckless driving crash in Heidelberg that claimed the life of his passenger and friend, Juandré Kleinhans (19).

The Heidelberg Magistrate’s Court has sentenced 20-year-old Alec Smith, who was behind the wheel during a motor vehicle accident in the early hours of December 30, 2023.

Smith’s vehicle collided with a palm tree on the corner of Roets and Plein streets in Rensburg.

Before sentencing, Smith pleaded guilty to reckless and negligent driving, and the plea stood throughout the trial.

Both the defence and the State presented arguments before Magistrate Gerhard Strydom, putting forward recommendations that included licence suspension, a prison term, a fine, a suspended sentence, community service, and house arrest.

During sentencing, Strydom said culpable homicide cases are among the most difficult to preside over, as the actions are usually not planned in advance and often occur on the spur of the moment.

The court took into account that Smith had shown remorse and that his family assisted financially with Kleinhans’s funeral costs.

Strydom noted that Smith still has his whole life ahead of him and that the death of his friend would haunt him for the rest of his life.

Smith was handed a four-year prison sentence, suspended for five years on condition that he is not convicted on any similar charges during that period.

In addition, he must complete 100 hours of community service at Heidelberg SAPS.

He will also remain under house arrest until September 30, 2026. Smith may leave home for work during the week but must return immediately afterwards. On weekends, aside from his community service obligations, he is confined to house arrest.
