No jail for killer

The ex-policeman who shot and killed an Aston Manor woman in front of Kempton Park Police Station, will not go to jail.

Sgt Manape Phineas Kgoale (41) was sentenced to five years in prison, suspended for five years, in Kempton Park Regional Court on Friday.

He was convicted of culpable homicide as there was not enough evidence to find him guilty of murder.

Kgoale shot and killed Jeanette Odendaal (45) on April 26, 2011, while she was sitting in her car in front of the police station.

At the time a car guard ran into the police station, shouting someone was stealing a car. Kgoale ran out and saw Odendaal bumping into the cars in front of and behind her vehicle.

The accused’s lawyer, Riaan Louw, stated during his disciplinary hearing it was dark outside and Kgoale could not see who was in the car. He saw something in the driver’s hand and fired a shot.

A cell phone was later found in Odendaal’s hand. The last number she called was 10111.

Regional court Prince Manyathi also sentenced Kgoale to 18 months correctional service. He must do 16 hours a month community service, is under house arrest and is not allowed to use alcohol or drugs.

He must also attend programmes to learn to control his anger and is not allowed to move or travel.

Kgoale was dismissed from the police in August 2011.
