Footballer convicted over fatal Thembisa crash that killed girl (9)

The charges stem from a fatal collision on Andrew Mapheto Road in Thembisa during the early hours of October 30, 2024.

Footballer Mokete Sean Mogaila, 29, has been convicted of culpable homicide and failure to render assistance after pleading guilty to charges arising from a fatal collision in Thembisa.

The National Prosecuting Authority (NPA) welcomed the conviction following Mogaila’s appearance in the Tembisa Magistrates’ Court, where he entered a guilty plea in terms of Section 112(2) of the Criminal Procedure Act.

In his plea statement, Mogaila admitted to all the elements of the offences and accepted the facts and allegations presented by the State.

Mogaila admitted that the vehicle he was driving veered into oncoming traffic and collided with another vehicle occupied by a woman and her two children.

The crash claimed the life of nine-year-old Gomolemo Mavimbela. Her mother and 13-year-old brother sustained serious injuries.

Mogaila fled the scene after the collision but later handed himself over to law enforcement authorities on the same day.

During the investigation, police discovered alcohol bottles and drugs inside his vehicle.

Following his guilty plea, the court convicted Mogaila on all three charges. The matter was postponed to November 17, 2026, for sentencing proceedings.

“The NPA welcomes the guilty plea and conviction, which not only hold the accused accountable for his unlawful conduct but also spare the victims and their family the emotional burden of a lengthy trial. The conviction represents an important step towards justice for the deceased child and her family,” said Magaboke Mohlatlole, NPA Communications Officer in the Gauteng Division, Johannesburg.
