State fails to secure key witness in Rosemary Ndlovu case
Ndlovu, formerly stationed at the Tembisa Police Station, and Mudau, who served at the Norkem Park Police Station, are accused of conspiring to kill Mudau’s ex-husband
Convicted serial killer and former police officer Nomia Rosemary Ndlovu appeared in the Kempton Park Regional Court on May 22 alongside her former colleague, Nomsa Mudau, on charges of conspiracy to commit murder.
The case was postponed to June 5 for further investigation.
Today (June 5), the matter was again postponed for a Section 174 application.
Advocate Malatola informed the court that he had failed to secure the cooperation of a third alleged hitman, who was expected to testify.
“Due to some logistics, I couldn’t secure the evidence intended to,” Malatola told the court.
As a result, the defence indicated it would proceed with the Section 174 application, which could see the charges dismissed due to a lack of sufficient evidence.

On April 8, one of the alleged hitmen, Lakhiwe Mkhize from Tembisa, testified that Mudau had contacted him directly and met with him alone.
According to Mkhize, the plot to carry out the murder failed after the hitmen warned Justice about the plan.
It is alleged that Mudau promised to pay the hitmen using proceeds from a life insurance policy she had taken out in her ex-husband’s name. However, instead of following through, the hitmen tipped him off.
Mkhize said he had never met Mudau before the arrangement and claimed Ndlovu was the one who informed him about the meeting.
When Advocate Malatola asked about a payment Mkhize allegedly received from Mudau, he testified that she had handed him R3 000 at her home.
When asked if the money was intended for petrol, Mkhize said he was unaware of such a detail.
“I believe Mtshali – another alleged hitman – kept the petrol money for himself because he was the one who arranged the car,” Mkhize said.
He stated he was unaware of any other payments related to the alleged plot.
“I gave Mtshali Mudau’s cellphone number while we were at the hostel because I was ignoring her calls. She later called Mtshali and asked why I wasn’t answering,” he testified.
“She also told Mtshali that she had given me R3 000 for the mission to kill her husband.”
Malatola said Mtshali had previously testified about how the murder was to be carried out. Mkhize confirmed this and said the instructions were very clear.
“I only knew where to find Justice. Mudau told us what time he got home from work and gave a description of his car. We were promised R15 000 for killing him,” Mkhize said.
Malatola then asked if he knew “the Venda guy,” to which Mkhize replied that the man was his neighbour.
“I was the one who suggested we go to Musanda because he speaks the same language as Justice. But Justice didn’t want to hear anything we were saying about his wife,” he said.
Malatola told the court that Mudau claimed Mkhize had unexpectedly contacted her, asking to meet at Mooifontein Cemetery. She allegedly expressed surprise and questioned how he had obtained her contact details.
Mkhize denied this, stating it was a misunderstanding and that Mudau’s version was “out of line.”
