Independent probe launched into death of Grade 5 learner in Thembisa
Gauteng Education MEC Matome Chiloane has appointed a law firm to investigate the circumstances surrounding the death of a learner at Reagile Primary School.
Gauteng Education MEC, Matome Chiloane, on March 18, formally introduced the law firm appointed to conduct an independent investigation into the circumstances surrounding the death of 10-year-old Milton Neo Mokgoatsane.
Neo, a Grade 5 learner at Reagile Primary School, died after a tragic incident at the school in Winnie Mandela, Thembisa.
According to reports, the incident occurred on February 16, during the second break.

A group of learners, including Neo, was playing around the soccer goalposts when one of the structures fell on him, causing severe injuries.
Paramedics were called and arrived within approximately 20 minutes. Despite efforts to resuscitate him, Neo was declared dead at the scene.

The appointed law firm, KRM Inc, has been mandated to conduct an independent investigation into the incident.
As part of the process, Chiloane first met with the Mokgoatsane family to formally introduce the legal team.
He then visited the school, where the firm was introduced to the school management team (SMT) and the School Governing Body.

During both engagements, the MEC outlined the purpose, terms of reference and scope of the investigation.
The investigation will include consultations with the district director, circuit manager, cluster leader, principal, educators, the learner’s family, fellow learners and any other relevant witnesses.
It will also produce clear findings and specific recommendations in relation to applicable legislation, including the South African Schools Act, the Employment of Educators Act and the Children’s Act.
This will include identifying any legislative contraventions and advising on possible disciplinary action.
The scope will cover the circumstances surrounding the incident, the conduct of educators, the SMT and the principal, and whether proper reporting procedures were followed.

It will also examine the cause of death, adherence to legal obligations regarding learner care, any potential liability or omissions by the department, the role of the SGB, and the provision of counselling.

Chiloane reiterated the department’s commitment to establishing the truth, noting that this resolve is shared by the Mokgoatsane family.
“We trust fully in the capacity of the independent law firm to execute a rigorous and unbiased investigation. As demonstrated in our past interventions, the department will not hesitate to take decisive action based on the outcomes of this report,” he said.
