City takes illegal flat owner in President Park to court over illegal building

City spokesperson Nthatisi Modingoane said they took the owner to court after their notices were ignored.

The city’s Region A oversight inspection into the illegal flat units in President Park found that the owner ignored various city notices and communications.

City spokesperson Nthatisi Modingoane said the flat units were not legal and have not been rezoned for residential use as they were built in an area zoned as an agricultural holding.

The oversight inspection on June 18 was conducted with building control, environmental health, and JMPD officers.

He said that as a result, the city had taken this matter to court, and it was expected that it would be heard in September this year.

“From the recent inspection, there were other environmental infringements identified. The city is putting together a plan for an operation that will include various departments, including the Home Affairs Department, to deal with various infringements at the property,” said Modingoane.

In the article, Disaster in the making, [Week ending 13 June 2025], a neighbour of the property claimed that in June 2021, the city’s chief building inspector had issued a notice that all construction work must cease with immediate effect. However, the plot owner continued with the development.

Ward 110 councillor Angie Mphaho said, “The oversight went very well. We found that they are still building more flats. While there, we found over 600 flat units with no building papers from the city’s building inspectors.”
