BE PLEASED TO TAKE NOTICE THAT the Applicants intend to apply to the abovementioned Honourable Court on the 30TH day of OCTOBER 2026 at 10h00am or so soon thereafter as Counsel for the Applicant may be heard for an order in the following terms:
1. Granting the Applicants leave to change the matrimonial property system which is applicable to their marriage in terms of section 21(1) of the Matrimonial Property Act, 88 of 1984 (`the Act`), from married in community of property, to out of community of property without accrual.
2. That the Applicants be authorised to enter into a Postnuptial Notarial Contract, which contract will regulate their matrimonial property once registered, in terms of the provisions of the draft Postnuptial contract, annexed to the application as Annexure `N1`.
3. That the Registrar of Deeds, Mbombela, be authorised and ordered to register the Postnuptial contract concluded between the parties within three (3) months from the date of this order and subject to compliance with all the statutory requirements.
4. That the Applicant`s marriage be regulated by the said Postnuptial contract from the date of registration thereof, thereby being out of community, without the application of the accrual system.
5. That such an order shall not prejudice the rights of any of the Applicant`s pre-existing creditors.
6. Further or alternative relief be granted to the Applicants.
ANY OBJECTION to this application should be forwarded, before the date of hearing, to the Registrar of the Honourable Court at the High Court Building situated at Samora Machel Drive, Mbombela and to the parties attorneys of record namely MEINTJES AND KHOZA ATTORNEYS, Email: litigation@meintjieskhoza.co.za, Tel: 013-752-5449, 37 Brown Street, 8th floor Midcity building, Mbombela.
KINDLY TAKE FURTHER NOTICE that the full application and supporting affidavit is available for inspection at the Applicant`s attorneys of record, Meintjes and Khoza Attorneys, as aforesaid, Monday to Friday between 08h00 and 16h00.
