Mpumalanga High Court names interim curator for David Mabuza’s estate
The appointment of a neutral interim curator will allow for the controlled release of funds from the late former deputy president’s estate to meet maintenance, subsistence and education needs of beneficiaries.
The Mpumalanga Division of the High Court has directed the Master of the High Court in Mbombela to appoint a neutral and independent interim curator to the estate of the late former deputy president David Dabede Mabuza.
The High Court’s Deputy Judge President Takalani Ratshibvumo heard an urgent application filed by Mabuza’s daughter, Tamara Silinda, and her mother Emunah Silinda (formerly known as Ruth Funi Silinda).
Lowvelder reports the applicants were seeking relief that would direct the Master of the High Court to expedite the appointment of a curator for interim maintenance in respect of Tamara and subsistence relief for her mother.
Agreement reached on who should be appointed
The lawyers representing both sides held discussions and reached a common agreement that an interim curator should be appointed for the sake of all Mabuza’s beneficiaries.
The lawyers informed the judge about their agreement and he made it an order of the court, subject to the supervision of the Master of the High Court in Mbombela.
“The curator will exercise powers solely for the purposes of interim maintenance, including authority to consider requests for interim maintenance by all dependent children and beneficiaries of the deceased estate who are in need of assistance,” said the judge in his order.
Rights of the interim curator
He ordered that the interim curator release money and such movable property out of the deceased estate as, in the interim curator’s opinion, are sufficient to provide for the subsistence of the deceased’s family or household.
“The interim curator is authorised and directed, as a matter of priority, to consider and process the dependent children’s educational expenses and make payment to the relevant institutions within five days of his or her appointment, having regard to the availability of liquid funds in the deceased estate,” said the judge.
Advocate DJ Sibuyi, for the applicants, welcomed the court order saying it would be helpful to all of Mabuza’s dependants.
