Vryheid man gets 45 years for raping children

A 32-year-old man has been sentenced to 45 years’ direct imprisonment by the Vryheid Regional Court after being convicted on two counts of rape, two counts of sexual assault and two counts of sexual grooming of children. The offences were committed in the Dudusini Scheepersnek area between September and October 2024.

The victims, who are cousins, were aged 10 and 12 at the time. According to evidence presented in court, the accused, who was the children’s neighbour, called the girls to his home in September 2024. He took them behind his house, where he showed them a pornographic video and instructed them to imitate what they had watched. He then sexually assaulted and raped one of the girls (first complainant), before raping the other girl as well. The court also heard that in October 2024, the accused sexually assaulted the second complainant.

Abuse uncovered after children spoke out

The abuse came to light after the girls disclosed what had happened to other children, who in turn told their elders. The incident was then reported to the authorities, leading to an arrest. During the trial, prosecutor Kwazikwakhe Sibiya led the evidence of both victims and the ‘first report’ witness. The state also submitted Victim Impact Statements prepared by the first complainant and her mother, with the assistance of court preparation officer Bheki Hopewell Sithole.

In her statement, the girl said she had regarded the accused as an uncle and trusted him, adding that she never expected him to harm her. Her mother said she had treated the accused like a brother and believed he would protect the children rather than abuse them.

Court imposes effective 45-year prison sentence

The court handed down a sentence of five years’ imprisonment on each of the two counts of sexual grooming of a child, five years on each of the two counts of sexual assault, and 20 years on each of the two counts of rape. Although the prescribed minimum sentence for rape was life imprisonment, the court found substantial and compelling circumstances to justify a lesser sentence. It considered the perpetrator’s relative youth, his family responsibilities and his potential for rehabilitation. Some of the sentences were ordered to run concurrently, resulting in an effective sentence of 45 years’ direct imprisonment. The court also declared him unfit to possess a firearm and ordered that his name be entered into the National Register for Sex Offenders.

NPA welcomes conviction and sentence

The National Prosecuting Authority (NPA) welcomed the successful conclusion of the case, saying it hopes the sentence will deter would-be offenders. “Children are among the most vulnerable members of society and must be protected from all forms of abuse and exploitation,” the NPA said.
