With reference to Concerned Resident’s letter (Struggling to live, February 28, page 6), the municipality must have passed by-law for the late payment fee, this brings to mind some questions:
1) What date was the by-law passed?
2) How was the amount of the late payment fee calculated?
3) Which section of the Municipal Financial Act allows a late payment fee?
Interested Resident

1. The late payment fee is part of the Municipal Tariffs, which is always raised on overdue accounts, unpaid accounts and on balances outstanding. Indigent customers are not charged any penalties or late payment fees.
2. It is calculated annually in the tariff of charges and it is a standard fee raised monthly on all outstanding accounts.
3. Section 74 of the Municipal Systems Act of 2000 (Tariff Policy and Municipal Credit Control and Debt Control and Section No 64.2 (g) of the Municipal Finance Management Act No 56 of 2000.
