INVITATION TO REGISTER AND COMMENT
NOTICE OF APPLICATION FOR THE RECTIFICATION OF UNLAWFULL COMMENCEMENT OF LISTED ACTIVITIES IN TERMS OF SECTION 24G OF THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT (NO 107 OF 1998) FOR THE CLEARANCE OF INDIGENOUS VEGETATION ON THE PROPOSED PORTION 1 AND THE PROPOSED REMAINING EXTENT OF HOLDING 27 PROTEA RIDGE AGRICULTURAL HOLDINGS IN MOGALE CITY LOCAL MUNICIPALITY, GAUTENG PROVINCE. Notice is hereby given in terms of Section 24G read together with sections 24F of the National Environmental Management Amendment Act (Act No. 107 of 1998) (as amended) that Mr. Steve Vorster, is applying for rectification to the Gauteng Department of Environment (GDE). The application is being undertaken to rectify the unlawful clearance of indigenous vegetation for the construction of a furniture factory, minor offices and a parking yard for the transportation business, occurring on the premises in Krugersdorp under Mogale City Local Municipality, Gauteng Province. The unlawful clearance and construction commenced in August 2020.
In terms of Sections 24(2) and 24D of the National Environmental Management Act (Act No. 107 of 1998), as amended, and as read with Listing Notice 1 and Listing Notice 3 (Government Notices R. 327 and R. 324, in Government Gazette 40772 of 07 April 2017), the triggered activities include Listing Notice 1, Activity 27 and Listing Notice 3, Activity 12. The unlawful activities commenced illegally without the necessary Environmental Authorisation. The application is thus for ex post fact approval in respect of the illegal activities. The activities were at all relevant times, listed pursuant to section 24(2) of NEMA as activities that require an Environmental Authorisation before they may be commenced. Rectification will be undertaken through the Sections 24G of the National Environmental Management Act (Act No. 107 of 1998).
