Fourth Respondent ORDER Having considered the matter and having heard counsel for the applicant, I hereby make the following order:
IT IS ORDERED THAT: – 1. The rule nisi granted on 11 September 2023 by the Honourable Judge Wepener, extended by the Honourable Judge Strydom on 14 February 2024, extended by the Honourable Judge Opperman on 02 May 2024, extended by the Honourable Judge Mudau on 29 July 2024, extended by the Honourable Judge Kilian AJ on 16 September 2024, extended by the Honourable Judge Dippenaar J on 22 October 2024, extended by the Honourable Judge Fisher on 21 January 2025, extended by the Judge Motha on 29 July 2025, extended by the Honourable Judge Mudau on 12 November 2025, extended by Judge Motha on 04 May 2026, extended by Judge Goedhart AJ on 20 July 2026, is hereby extended to 26 October 2026 at 10h00 or so soon thereafter as counsel for the applicant may be heard.
2. All persons who have a legitimate interest are called upon to put forward their reasons why this Court should not order the final winding-up of Beryl Coal (Pty) Ltd on the abovementioned date.
3.A copy of this Order be forthwith served on Beryl Coal (Pty) Ltd at its registered address and be published in the Government Gazette and in the local newspaper.
4.The costs to be costs in the liquidated estate.
