The state’s appeal against Oscar Pistorius’ conviction has been set for 3 November.
The National Prosecuting Authority (NPA) wanted the Supreme Court of Appeal to overturn Pistorius’ culpable homicide conviction.
Instead it wanted him to be found guilty of murder.
Pistorius was found guilty of culpable homicide in September last year, for shooting dead his girlfriend Reeva Steenkamp in his mansion in February 2013.
The Paralympian was sentenced to five years at the Kgosi Mampuru II prison.
He was expected to be released to house arrest on 21 August, however, Justice Minister Michael Masutha sent that decision to be reviewed by the parole board.
Last Friday, the parole board met in Durban to review Pistorius’ parole, but postpone it to October.
