The man accused of raping and forcing his family’s domestic worker to perform sexual acts with his dogs has been denied bail by the Bronkhorstspruit Magistrate’s Court.
Magistrate David Shikwambana on Thursday said the defence failed to prove that there were exceptional circumstances for the man to get bail.
“The defence also failed to give the motive why the woman would make such claims,” he said.

Shikwambana also said it would not be in the interests of public order to have the accused released on bail.
It is alleged that the 45-year-old man forced the woman to masturbate the dogs before performing oral sex on them.
The man allegedly went on to force the woman to have sex with the animals before raping her multiple times.
National Prosecuting Authority’s Solly Leballo said granting the man bail would have undermined the public’s confidence in the justice system, forcing members of the community to take the law into their own hands.
Leballo said this was no ordinary rape case as the allegations against the man were degrading and left many shocked.
“This is the first time I have ever come across such a case in my 20-years’ experience as a prosecutor.”

In November the man abandoned his first bail application after members of the community protested outside the court in support of the woman.
In the court gallery on Thursday, members of the community wearing clothing from various political organisations held up placards in demonstration.
The man’s attorney Ehleketani Maluleke accused community members of not having genuine interest in the case, but were trying to use it to canvass for votes in preparation for the 2019 elections.
Maluleke also accused the investigating officer of being biased and only investigating one side of the story.
She said the officer failed to investigate claims that the two were lovers that had consensual sex on the day.
Leballo refuted this, saying that the two had nothing more than a “employer-employee” relationship.
“If indeed sexual intercourse was consensual, why did the woman sustain injuries including an open wound to her thigh, vagina and her feet?” Leballo said
“The woman has a life partner with whom she stays. She only went to the man’s house to perform her duties.”

On Monday investigating officer Shane van Rooyen testified that the neighbours heard the woman crying, but assumed that it was the usual altercation between the man and his parents.
According to Van Rooyen the 41-year old woman escaped after spraying deodorant in the man’s face and was helped out of a locked gate by the accused’s father.
The dogs that were involved in the alleged incident were taken away from the family, but the man has applied to have them returned.

Leballo said they were not in a position to attend to the man’s application as the dogs played a major part in the investigation.
