The three men arrested during a protest against the Shepherd Bushiri-led Enlightened Christian Gathering church are due back in court on Thursday.
Their case was postponed last week when one of the accused failed to attend proceedings.
A warrant of arrest was subsequently issued for Prince Gcaba.
The trio’s lawyer Vicent Shela said he had only been in consultation with two of the accused since their first appearance on 8 January 2019.
“The third accused [Gcaba]… having all my contact details and business address, has not paid a visit to my office and has not communicated with me telephonically.”

Gcaba, Kabelo Tladinyane and Kennedy Nemoshongwa were arrested for alleged public violence and the violation of a road traffic act on 6 January 2019 during the third day of demonstrations outside the Pretoria showgrounds where the church holds its services.
Shela said he did not have any instructions about Gcaba’s whereabouts nor where he stayed.
“I have just learned that he does not stay at the address he gave in court which means he misled the court and myself.”
He said the alleged falsified information led him to request Gcaba’s warrant of arrest “with immediate effect”.
Shela said it was Gcaba’s “baby and burden” to give a justifiable reason for why he failed to be in the courtroom at 8:30 as the accused were instructed when they were granted R500 bail each.
Gcaba, however, later claimed he was sitting outside the courtroom throughout.
The trio was part of the protests against the perceived role of the church in the death of three congregants and injury of 17 others in a stampede during a sudden storm.
Gcaba, despite being shot at in the face and allegedly participating in the demonstrations against the church, had since gone back to “seek forgiveness” from Bushiri, known by adherents as “Major 1”.
