Pretoria prosecutor to answer for reportedly avoiding to enroll case for fee

The prosecutor was granted bail and the matter was postponed to December 8 for further investigation.

The Pretoria Specialised Commercial Crimes Court granted a 54-year-old prosecutor bail of R3 500 last week.

Her case has been postponed to December 8 for further investigation.

District Court Prosecutor, Thandwa Johanna Moseneke was charged with corruption and defeating the ends of justice.

Moseneke, who is based at the Pretoria Magistrates’ Court, appeared in court on September 11.

According to Lumka Mahanjana, spokesperson for the National Prosecuting Authority (NPA), the matter stems from an incident in July 2021.

“A man arrested for theft of medicine from his employer allegedly offered money to the investigating officer to prevent his case from proceeding.”

She said the man reportedly paid R2 000 in cash and a further R3 000 via electronic transfer from his wife’s account.

Mahanjana added that the investigating officer allegedly handed R1 000 to Moseneke in exchange for not enrolling the case in court on July, 20, 2021.

The accused was never prosecuted, and the matter was subsequently declined for prosecution.

“The case came to light after the employer complained to police management.

“A subsequent investigation revealed that the investigating officer had received money and implicated Moseneke as having accepted funds to avoid enrolling the case.”

Mahanjana said the officer was disciplined internally, dismissed from the South African Police Service, and later criminally charged.

She said on September 10, he pleaded guilty to corruption under a plea and sentence agreement with the state and received a five-year suspended sentence, confirming that he paid money to the prosecutor.

“Moseneke handed herself over at Wierdabrug Police Station on September 11, and was formally charged,” said Mahanjana.

The court imposed strict bail conditions, including not interfering with state witnesses, notifying the investigating officer before travelling outside Gauteng, refraining from committing any further offences, and not applying for a new passport.

“The NPA remains unwavering in its commitment to fighting corruption, including within its own ranks.

“No official is above the law, and the NPA will continue to act decisively wherever misconduct threatens the integrity of the criminal justice system.”
