The Evander Magistrate’s Court granted bail to a 51-year-old state prosecutor and his 52-year-old co-accused today, August 27.

The two men face charges of rape, sexual assault and crimen injuria involving an adult woman.

They were arrested on August 20 and made their first court appearance on August 21, when the matter was postponed for a formal bail application.

Yesterday the court heard affidavits from both accused, along with the defence’s arguments in support of bail, while the State opposed their release.

The State argued that sexual offences have been declared a national pandemic by President Cyril Ramaphosa and maintained that it has a strong case against the accused.

In opposing bail, the prosecution cited the seriousness of the schedule 6 offences, the nature and consequences of the alleged crimes, and concerns that the complainant lives in fear of intimidation.

The State also argued that granting bail could provoke community outrage and undermine public confidence in the justice system.

The defence submitted that neither accused posed a flight risk and said both were willing to surrender their passports and report regularly to a police station if released.

They argued that the men have families who depend on them, would not interfere with witnesses or the investigation, and would not jeopardise the functioning of the criminal justice system.

Both accused intend to plead not guilty and stand trial. They maintained their innocence, claiming they are being unlawfully incarcerated for offences they did not commit.

The defence further submitted that both men suffer from chronic medical conditions requiring ongoing medication.

The court granted bail to the amount of R3 000 for both the accused. They are expected back in court on October 22.
