Property management company denies claims

The owner of Vicky’s Restaurant is consulting with her lawyers after she accused the property owner of the building that houses her restaurant of ‘illegally’ evicting her.

Vicky Seboyane, owner of the restaurant which is situated along Louis Botha Avenue in Orange Grove, claimed she was evicted for no apparent reason.

“Some of my valuables were just scattered outside the building,” said Seboyane alleging that they even locked her valuables outside the shop unattended.

Seboyane shared her story with North Eastern Tribune and said she had sought legal advice. According to her, two men dressed in overalls came in and informed her that they’ve been sent to do painting and allow them space to work. “But to my surprise, I received a call from other tenants leasing apartments upstairs late at night informing me that my valuables were scattered and locked outside the building,” claimed Seboyane.

“I’m really shocked by this because I was not given any notice to vacate the place, instead they did it under false pretences as though they’re renovating the shop.”

Seboyane furthermore, blatantly accused the building owner of collecting monthly rent but failing to pay for municipal services citing water and electricity. “We pay R10 000 a month but we’re constantly threatened by municipal contractors wanting to cut off either water or electricity – and when it does happen he will then get someone to reconnect illegally,” she alleged.

In an email reply to the questions sent by Tribune to Modicai Mnculwane, the chief operations officer of Mafadi Property Management Company which manages the building, Seboyane denied that Seboyane was evicted. Mnculwane said, as far as they knew, there was no situation nor problem and added that the tenant, Seboyane, vacated of her own will.

He also denied that the monthly rent was R10 000. According to him, the rent is

R6 000 which includes water and electricity. “The tenant owes R77 543 and she hasn’t paid for about 10 months but she was not evicted,” claimed Mnculwane.

“The tenant’s lawyer has been engaging with our lawyers and they came to the conclusion that if rent hasn’t been paid at a certain time, their client will vacate the property. We welcome that her lawyer has been engaging with our lawyers for over a year to find a solution.”

Regarding the accusation of failing to pay for municipal services, Mnculwane said, “It’s highly incorrect, the tenant has had a legal representative all the time, a very big law firm representing her for the entire 2017.”
