TRUCK driver Mohammed Sathar, who shot Margate man Richard Duxbury (35) in the head in a road rage incident on the M4 near Montclair three years ago, was convicted in a Durban regional court last Friday.
Sathar pleaded not guilty, but Magistrate Stanley Luthuli disagreed and found him guilty of murder and pointing a firearm.
He rejected Sathar’s version of events and said he had been an evasive witness. He accepted the testimonies of Duxbury’s father, Brian, and other state witnesses, saying they had impressed the court with clear, logical evidence.
He said Sathar had pointed his firearm at Duxbury without any provocation and this had been a ‘deliberate, calculated act’.
Sathar claimed ‘big men carrying what looked like sticks’ appeared in the middle of the road while he was driving. He said that when he slowed down, one of the men jumped on to the steps of his truck and assaulted him. He reached for his gun and it went off.
However, Duxbury senior testified that Sathar had forced their bakkie off the road and onto an island where it came to a stop. He added when his son approached the truck, he was shot in the head.
His testimony was confirmed by a police forensic analyst. Sathar was remanded to Westville Prison and will be sentenced in October.
