Man gets 23 years for raping teen
The man forced the teen into the car at knifepoint and later raped her.
LINDA Arnold Ncayiyana (25) from Extension 3, Margate, was sentenced by Magistrate Johann Bester in the Port Shepstone Regional Court to 23 years’ imprisonment for the kidnapping and rape of a 14-year-old schoolgirl in October 2011.
The teenager left her home in Extension 3 one evening to borrow a DVD player from neighbours. As she walked down the road, a vehicle with two men inside stopped behind her. One of the men forced her into the car at knifepoint. She was driven to a vacant house a few blocks away and the knifeman forced her into the house through a broken window and raped her. He then let her go.
She was unable to recognise the man, but the police, acting on a lead, apprehended one of the men two years later and connected him to the crime through DNA.
Ncayiyana, represented at his trial by Herman Horn, denied the charge and disputed the scientific evidence.
The court noted that a medical doctor at Port Shepstone Regional Hospital as well as two police officers had made errors, but the integrity of the exhibits and the DNA investigation had not been compromised.
However, the court drew attention to the carelessness of the investigation that could easily have resulted in the acquittal of a guilty person. It had also resulted in the trial becoming unnecessarily protracted at considerable cost to the taxpayer.
