The two appeared before Regional Magistrate Johann Bester on charges of culpable homicide following the death at the centre of drug addict, Blair Trouchet (28) on February 23, 2011.
The court was informed that due to the expected length of the trial, the director of public prosecutions had decided the matter was to be heard in the Durban Regional Magistrate’s Court.
The court further heard that the director of public prosecutions was also looking to prosecute the closed corporation (owner of the recovery centre) and needed time to consider which prosecutor would be appointed.
The trial follows the outcome of a Port Shepstone inquest that Mr Cooper and Dr Stewart may have been criminally liable for the death of Miss Trouchet.
