Demolition progress

Emalahleni Local Municipality issued a press release on the progression of the Demolition Project.

The update report on the demolition of illegal buildings and non compliance zoning regulations is listed as follows:

  • Demolition started on September 22 to demolish an illegal church structure at stand 1366 Hlalanikahle ext 3.
  • On October 10 an illegal outbuilding with approximately 30 rooms in 38 Hertzog Street was demolished.
  • On October 15 an illegal tuck shop on stand 268 Van de Venter Street was demolished.
  • On October 16 an illegal tuck shop on stand 221, 33 Jellicoe Street was demolished
  • On October 16 an illegal tuck shop on stand 367, 25 Allenby Street was demolished.
  • In October an illegal tuck shop on stand 283 Van de Venter Street was demolished.
  • On October 20 an illegal tuck shop on stand 349 Duvha Park was demolished.
  • On October 20 an illegal tuck shop on stand 252 Kiepersol Street was demolished.
  • On October 21 six Wendy houses on stand 396 Robertson Street were demolished.
  • On October 22 a big illegal tuck shop on stand 4983 Van de Venter Street was demolished.
  • On October 23, 33 Wendy’s on stand 4983 Van de Venter Street were demolished.
  • On the October 23 an outbuilding flat on Erf 238 Van de Venter Street was demolished.
  • On October 28 people were moved out of a dangerous building in Van de Venter Street.
  • On October 29 notice was given to the owner of stand 708 Hertzog Street to demolish all the illegal structures himself.

Updates on demolitions in November are still to follow.

There are rules and regulations that must be followed before the demolition of certain buildings are considered.

“If the Local Authority is of the opinion that: Any building is dilapidated or in a state of disrepair or shows signs thereof it may be by notice in writing served on the owner of such building in the period specified in such notice to demolish such building or alter it in a manner that it will no longer be dilapidated, provided the Local Authority is of the opinion that the condition of any building, is such that steps should forthwith be taken to protect life and property it may take such steps without serving or delivering such notice on the owner of such building, and may recover the cost of such steps from the owner,” the press release read.

“It must be noted that if a court order was granted for the demolishing of an illegal building, submitting an application in terms with the provisions of the Town Planning Ordinance 1986 to obtain the necessary land use rights to legalize the building, will not stop the legal process that has already started.”

The owners of illegal buildings were once again warned to take the notices served on them seriously and not to ignore the orders given to rectify their situation and obtain the correct building plans.
